EXPLORE GALAXY S25 COMPETITION TERMS AND CONDITIONS
Please read these Competition terms and conditions (“Terms and Conditions) carefully. Participation in this Competition will constitute your agreement to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate in this Competition. All participants during the term of this Competition agree to be bound by the following Terms and Conditions.
1. Competition:
1.1. The Competition will be known as the Explore Galaxy S25 competition (“Competition”).
1.2. The organiser of the Competition is Samsung Electronics South Africa Proprietary Limited, registration number 1994/003872/07 and/or its agencies (“Organiser”).
1.3. Entry into this Competition is limited to the participants as defined in clause 3.1 below. Accordingly, any application for entry into this Competition, which is made by a third party on behalf of a participant, is strictly prohibited and will result in immediate disqualification from participation in this Competition.
2. Competition Period:
2.1. The Competition will run from 19 March 2025 [00h00] to 6 April 2025 [23h59] (“Competition Period”).
2.2. The duration of the Competition Period may be extended or curtailed at the discretion of the Organiser.
3. Who may enter:
3.1. All participants must:
3.1.1. be citizens of the Republic of South Africa and/or a legal residents of the Republic of South Africa;
3.1.2. be residing in the Republic of South Africa at the date of the commencement of the Competition Period;
3.1.3. be natural persons and at least 18 years old at the date of the commencement of the Competition Period; and
3.1.4. must own a Samsung Galaxy S25 device.
3.2. Participation in this Competition excludes the Organiser, its directors, members, partners, employees, agents, consultants, any other person who directly or indirectly controls or is controlled by them or any supplier of goods and services.
3.3. Misrepresentation of participants by in-store sales representatives will result in the disqualification of the participant’s claim in the Competition and possible legal action.
4. How to enter the Competition:
4.1. In order to gain entry into the Competition, the participant must:
4.1.1. be a participant in terms of clause 3.1 above;
4.1.2. record a 30 second video giving their first impression of the Galaxy S25 and the feature of the week, as communicated by Samsung via TikTok and the Samsung Members page;
4.1.3. upload the video on the Samsung Members community page;
4.1.4. complete the competition form provided in the Samsung Members community page and provide their name, surname, cellphone number and link to their entry post.
4.2. Entry to this Competition does not make a participant a winner.
4.3. The Organiser accepts no responsibility for incorrect or incomplete entries or entries which are lost, misdirected, illegible, late, mutilated or altered. Entries that do not comply with these Terms and Conditions will be disqualified, subject to clause 4.4 below.
4.4. Errors and omission may be accepted at the Organiser's discretion. Failure by the Organiser to enforce any of its rights at any stage does not constitute a waiver of those rights.
4.5. Any entries that have not been received by 6 April 2025 (23h59) will be null and void and the participant will not be entered into the Competition.
4.6. It is the participant’s responsibility to ensure that any information which is provided to the Organiser is accurate, complete and up to date.
5. Can I qualify more than once for the Competition:
Entry into the Competition is limited to one entry per participant per week and should there be any dispute in this regard, the Organiser shall be sole adjudicator of the dispute and the Organiser’s decision shall be final.
6. Prize:
6.1. The draw for the Prize will take place in accordance with the provisions of clause 7.1.
6.2. The Competition will afford participants, who have complied with the provisions of clause 4.1, an opportunity to be entered into a lucky draw to stand a chance to win one of five weekly Samsung Online store vouchers valued at R1,500.00 each. (“Prize”).
6.3. The Organiser reserves the right to change the Prize should they deem necessary, to a prize of similar economic value.
6.4. The Prize is not transferable and no substitution, cash redemption or assignment of the Prize is permitted.
6.5. The Prize may differ from that shown on the promotional material with regard to colour and specifications.
6.6. Any and all tax implications and liabilities as a result of winning the Prize will be solely borne by the winner.
7. Draw:
7.1. The lucky draw for the Competition will be held by the Organiser on each Monday of the Competition Period commencing on 24 March 2025 with the last lucky draw to be held on Monday on 7 April 2025.
7.2. The draw will be supervised by an independent auditor, registered accountant, attorney or advocate.
7.3. A participant selected as a winner who does not comply with the provisions of these Terms and Conditions will forfeit the Prize.
7.4. Once a participant is selected as a winner, they will be contacted by the Organiser via the contact details provided in the competition form and requested to furnish a copy of their identification document or any other documentation, which the Organiser may require, in order to verify their identity and confirm that they have complied with the provisions of these Terms and Conditions.
7.5. In the event that the verification is successful and the Organiser is satisfied that the participant complies with these Terms and Conditions, the Organiser will forward further communication to the winner to confirm that they are a winner and provide details regarding the delivery of the Prize.
7.6. The Organiser shall in its sole discretion determine the time period for a Prize to be claimed or for delivery to be accepted.
7.7. In the event that a winner is unreachable within a period of 10 business days from the applicable draw date, ineligible or fails to claim or accept the Prize, the Prize shall be forfeited and another winner will be drawn by the Organiser.
7.8. The draw results to determine the winners are final and no correspondence will be entered into.
7.9. If for any unforeseen reason the draw cannot take place on the aforesaid draw date, then the Organiser will endeavour to conduct the applicable draw within a reasonable period thereafter and shall provide details of the new draw date on www.samsung.com/za/promotions.
8. Samsung Online Store Voucher Terms and Conditions:
8.1. The following terms and conditions apply to winner who receive a Prize, being a R1,500.00 Samsung online store voucher in terms of clause 7.1 above (“Voucher”).
8.2. Each Voucher:
8.2.1. has a unique voucher code which will be assigned to a winner;
8.2.2. is for R1,500.00 and may only be redeemed at the Samsung online store and not in any physical Samsung branded stores or any affiliate stores or websites which sell Samsung products;
8.2.3. may only be redeemed by the winner to whom it was issued upon reasonable evidence of their identity being confirmed through the creation of a user account on the Samsung online store or such other valid form of identity document as may be requested by Samsung and/or the Samsung online store;
8.2.4. cannot be used after the expiration of the Voucher;
8.2.5. is limited to a one-voucher-per-purchase basis and accordingly:
8.2.5.1. the Voucher may not be aggregated in respect of the purchase of any item. For example, if the stated price of an item exceeds the amount of the Voucher, then the winner must pay the balance in order to purchase the item and may not use other Vouchers in respect of that item;
8.2.5.2. the winner must use the full value of the Voucher when making the purchase, as any balance remaining after the purchase, will be forfeited;
8.2.5.3. may be used towards purchases of more than the value of the Voucher where the winner pays the balance using one of the accepted methods of payment on the Samsung online store;
8.2.6. cannot be transferred or assigned in any manner to any person and is not is not redeemable for cash;
8.2.7. is valid and may only be redeemed within a period of 6 months from the date of issuing of the Voucher (“Voucher Date"). Should there be any dispute in this regard, Samsung shall determine the Voucher Date according to its records and this date will be final and binding on the winner. Once the aforesaid 6 month period has elapsed, the Voucher will automatically expire and the Voucher code will no longer be valid on the Samsung online store.
8.3. Samsung shall endeavour to replace any damaged or defective products purchased using the Voucher in accordance with the provisions of the Consumer Protection Act. Other than in respect of damaged, defective or unsafe goods or for any other lawful reasons provided in the Consumer Protection Act, no refunds are permissible for any items purchased with the Voucher, provided that to the extent that a refund is permissible, the winner will be issued with a replacement voucher (with the same Voucher Date) and a refund of any cash amount contributed by the winner.
8.4. By making use of the Voucher, the winner acknowledges that he/she has read, understood and agreed to the terms and conditions set out herein and the terms and conditions of the Samsung online store;
8.5. Each winner will be required to create an account on the Samsung online store in order to redeem the Voucher.
9. Limitation of Liability:
9.1. To the extent permitted by Consumer Protection Act and any other applicable law:
9.1.1. the participant and winners hereby indemnify the Organiser against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused and whether it arose under the law of contract or delict or otherwise, because of the participant’s entrance to the Competition;
9.1.2. the Organiser excludes all warranties (express or implied), representations and liabilities regarding this Competition other than for death or personal injury caused by its negligence and/or fraud.
10. General:
10.1. The Organiser reserves the right, at any time, to verify the validity of entries and participants (including but not limited to a participant’s identity, age and place of residence) and to disqualify any participants who submit an entry that is not in accordance with these terms and conditions or who tampers with the entry process.
10.2. In accordance with the confidentiality policies and practices of the Organiser, none of the entry details of any participant in this Competition will be disclosed or used by the Organiser for any purposes other than for entry into the Competition.
10.3. Participants acknowledge and accept that the Organiser may utilise a third party to contact the participant, in the event that the participant is a winner and to arrange payment and delivery of the Prize. In order to affect the contacting and delivery process, the Organiser’s shall provide the participant’s information to such third party and by entering the Competition, each participant consents to this information being provided to the authorised third party.
10.4. The Organiser will not use details of participants for Samsung related communication should the participants opt-out to receive further communication from the Organiser.
10.5. Information regarding the Competition that is published on authorised advertising material will also form part of the Terms and Conditions of the Competition. In the event of any conflict between such advertising material and these Terms and Conditions, these Terms and Conditions shall prevail.
10.6. The Organiser may require the winner to be identified, photographed, filmed and the aforegoing to be published in any media and the winner's name and image may be published. Winners may however at any time decline the use of their name, likeness or image by the Organiser.The Organiser may in its sole discretion amend these Terms and Conditions at any time, without notice, and such amendments shall be deemed to have taken effect from the date of publication of the revised Terms and Conditions on www.samsung.com/za/promotions. The onus rests on the participant to constantly check the Organiser’s website for updates to the Terms and Conditions.
10.7. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Organiser, including but not limited to technical difficulties, unauthorised intervention or fraud, the Organiser reserve the right, in its sole discretion, to the fullest extent permitted by law to disqualify any participant or to modify, suspend, terminate or cancel the Competition as appropriate, subject to the approval of relevant regulatory authorities (if required).
10.8. Save as permitted by law, the Organiser reserves the right to cancel, suspend or terminate this Competition, without notice at any time, and such cancellation, suspension or termination shall be deemed to have taken effect from the date of publication on www.samsung.com/za/promotions.
10.9. No liability shall lie against the Organiser in favor of any participant, any winner and/or third party arising from such cancellation, suspension or termination. Accordingly, the participant waives their right which they may have against the Organiser and hereby acknowledge that they will have no right of recourse or claim of any nature whatsoever against the Organiser.
10.10. Any dispute or claim arising out of or in connection with the Competition shall be governed by and construed in accordance with the laws of South Africa.
10.11. The Organiser reserves the right to withhold the Prize until it is entirely satisfied that the claimant of the Prize is the bona fide winner, and reserves the right to call for such proof as it may deem necessary.
10.12. The Organiser accepts no liability or responsibility, whether occasioned by any circumstance not foreseeable and not within its reasonable control for late or delayed delivery of the Prize owing to, but not limited to, stock unavailability, strike, lock out, destruction of Prize on route to winner/s by any means, any civil commotion or disorder, riot, threat of war, any action taken by governmental authority or public authority of any kind, fire, explosion, storm, flood, earthquake or other acts of God.
10.13. If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable it will be:
10.13.1. read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible;
10.13.2. severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
11. Consumer Protection Act:
To the extent that the Terms and Conditions or any goods or services provided under the Terms and Conditions are governed by the Consumer Protection Act, no provision of the Terms and Conditions are intended to contravene the applicable provisions of the Consumer Protection Act, and therefore all provisions of the Terms and Conditions must be treated as being qualified, to the extent necessary, to ensure that the applicable provisions of the Consumer Protection Act are complied with.
